Primary responsibilities will be to provide advice and counsel to management and Human Resource professionals on a broad range of employment issues including: recruiting; hiring; employee relations; discipline and terminations; internal investigations; leaves of absence; wage and hour compliance; and EEO compliance. In addition, the responsibilities will include revising, preparing and conducting employment law training programs for HR and management, formulating and revising HR policies and procedures, assisting with strategic projects, drafting and responding to demand letters and administrative agency charges, and managing outside counsel on employment litigation matters and administrative charges.
ESSENTIAL DUTIES & RESPONSIBILITIES:
* Broad based knowledge of Federal, State and Local employment laws; multi-state experience preferred
* Counsel management in the resolution of issues and ensures compliance with federal, state and local laws and regulations, including, but not limited to, ADAA, FMLA, Title VII, USERRA, ADEA, FCRA, and FLSA
* Provide practical business-oriented solutions that enable management to achieve ultimate business objectives while minimizing legal exposure
* Provide training and updates for Human Resources, senior management, and other departments on employment compliance risk areas, trends, and labor and employment law developments
* Advise management concerning reductions in force, restructuring, severance plans, investigations, and negotiations with legal and government authorities
* Provide assistance on matters related to human resources, including training, employment policy and procedure, compensation issues, discipline and terminations
* Provide legal advice and services to senior management in order to support decision-making, policy development and ensure overall business and legal strategy is aligned
* Negotiate and draft settlement, severance and retention agreements
* Represent Company and conduct negotiations regarding legal terms and conditions, administration matters, and disputed issues
* Gather evidence and information and supervise investigations for management decision-making
* Conduct research, interview and consult with outside counsel and handle other details in preparation of legal documents
* Remain current on employment law trends and take proactive, affirmative steps to minimize potential legal exposure for the Company
* Ability to manage and coordinate special projects and workplace initiatives
* Oversee and manage litigation, administrative charges and investigations
ORGANIZATION RELATIONSHIPS: This position has no direct reports. The Senior Corporate Counsel works closely with the employment law team, others in the Legal department, as well as other departments within the Company, outside vendors, and outside attorneys.
REQUIRED QUALIFICATIONS:
1) Knowledge, skills & abilities:
* Diverse and well-rounded employment and labor law experience (including significant advice and preventative counseling background, and compliance and litigation experience)
* Ability to learn the business quickly, gain understanding of our systems and policies and integrate into the Company with little training and supervision
* Ability to work independently and with senior-level management
* Ability to manage outside counsel relationships in a cost-effective manner
* Ability to successfully interact with others in the department, Company, and outside parties in a professional and service-oriented manner
* Strong communication skills and technical ability
* Strong attention to detail
* Must be proficient in MS Word, Outlook, PowerPoint, and other computer systems
2) Minimum certifications/educational level:
* Strong academic credentials and law degree from an ABA accredited law school
* California State Bar member
3) Minimum experience:
* 5-10 years law experience in a mid to large size law firm or in house corporate legal department with sole or concentrated focus on employment law. In house experience strongly preferred.
4) Physical Requirements:
* Manual dexterity and range of hearing/vision sufficient to operate standard office machines
* Must be able to travel as needed via car and/or plane
